GENERAL BUSINESS TERMS AND CONDITIONS

§1 Sphere of Validity, Customer Information

The following General Business Terms and Conditions shall regulate the contractual relationship between SUNBOUNCE GmbH SUNBOUNCE Shop and the consumers and entrepreneurs who purchase goods via our shop. We shall not recognise any terms and conditions which oppose or deviate from our Business Terms and Conditions. The contractual language shall be German.

§2 Conclusion of the Contractual Agreement

  1. The offers on the Internet shall constitute a binding offer to you to purchase the goods.
  2. After entering your data and by clicking on the "Place order" button, you are hereby accepting this offer to conclude a purchasing agreement.

§3 Customer Information: Saving of Your Order Data

We shall save your order with details about the contractual agreement that has been concluded (e.g. the type of product, price, etc.). If you wish, we can send the General Business Terms and Conditions to you, but you may also review the General Business Terms and Conditions at any time on our web site even after the contractual agreement has been concluded.

As a registered customer, you may review your past orders via the customer log-in area (your account).

§4 Customer Information: Data Modification

You may modify/correct the information you have entered at any time by using the delete key before submitting the order. We shall inform you on the way through the ordering process about any additional data modification/correction possibilities. You may also completely end the ordering process at any time by closing the browser window.

§5 Return Shipping Costs in the Event of a Cancellation

In the event that you cancel the order, you must pay the costs for the return shipping if the delivered goods correspond to the goods that you ordered and if the price of the goods to be returned does not exceed an amount of 40 euro or if you have not yet rendered the counter-performance or a contractually-agreed partial payment for higher-priced goods by the point in time that cancellation is made. You must also pay only the standard costs for the return shipment. We shall pay any additional costs which are incurred owing to, for example, a change in our commercial residence or our requested commissioning of more expensive transport services.

§6 Reservation of Ownership

The purchased goods shall remain our property until payment in full has been made.

§7 Statute of Limitations Period for Your Warranty Claims

  1. Warranty for Consumers for Second-Hand Goods
    Your claims for defects for second-hand goods shall become statute-barred within one year’s time after the goods sold are surrendered to you. Exceptions to this provision shall be the following: Damage compensation claims, claims for defects which we maliciously conceal and claims from a guarantee which we have provided for the quality features of the goods. The legal statute of limitations periods shall be valid for these exceptional claims.
  2. Warranty for Entrepreneurs
    Your warranty claims for defects for the purchased goods shall become statute-barred within one year’s time after risk is transferred. The exceptions to this provision are the following: Damage compensation claims, claims owing to defects which we maliciously conceal and claims from a guarantee which we have provided for the quality features of the goods. The claim to legal recourse specified in § 478 BGB [German Civil Code] shall likewise be excepted. The legal statute of limitations periods shall be valid for these exceptional claims.

§8 Liability Restrictions

We shall exclude liability for contractual violations which are attributable to simple negligence insofar as they do not affect essential contractual obligations, damages owing to the loss of life, physical injury or damage to health, guarantees or claims in accordance with the German Product Liability Act. The same shall be valid for contractual violations committed by our vicarious agents and our legal representatives. Essential contractual obligations shall be considered to include particularly the obligation to supply the goods to you and to procure ownership to them for you. Furthermore, we must ensure that the goods do not have material and legal defects.

§9 Commercial Legal Venue

If you are an entrepreneur, the exclusive legal venue for all disputes arising from this agreement shall be our commercial residence.
